Terms of Service

These Terms of Service ("Terms") govern your use of fm.video, a service operated by Growth Spurt ("fm.video", "we", "us"). By using fm.video you agree to these Terms. If you do not agree, do not use the service.

1. The service

fm.video reads publicly available "now playing" information from radio stations and matches songs to their official music videos on YouTube, presenting them as continuous channels you can watch, queue, import into playlists, and share. Video playback is delivered by the embedded YouTube player. We do not host, own, or control the music videos; they remain the property of their respective owners and are subject to YouTube's terms.

2. Eligibility and accounts

You must be at least 13 years old (or the minimum age in your country) to use fm.video. If you create an account, you are responsible for keeping your login secure and for activity under your account. You may sign in by email or a supported identity provider.

3. Acceptable use

You agree not to:

  • use the service unlawfully or in breach of any third party's rights;
  • attempt to disrupt, overload, scrape, or reverse-engineer the service beyond what these Terms or applicable law permit;
  • circumvent the YouTube player, download content other than as expressly permitted, or misuse any rights holder's content;
  • submit content or station suggestions that are unlawful, infringing, or abusive.

4. Your content

Playlists, queues, and station suggestions you create remain yours. By making a playlist public or sharing it, you grant us a non-exclusive licence to store, display, and share it as part of operating the service. You are responsible for the content you submit and confirm you have the right to submit it.

5. Intellectual property and takedowns

Music videos and recordings belong to their respective artists, labels, and rights holders and are streamed via YouTube's official embed. fm.video's own branding, design, and software are our property. If you believe content surfaced through fm.video infringes your rights, contact us at info@growthspurt.agency and we will respond promptly; note that the underlying video is hosted by YouTube and may also be addressed through YouTube directly.

6. Third-party services

The service relies on third parties including YouTube/Google, Supabase, and analytics providers. Your use of those components is also subject to their terms and privacy policies. We are not responsible for third-party services.

7. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that any particular video will be available. Nothing in these Terms limits rights you may have under consumer laws that cannot be excluded.

8. Limitation of liability

To the fullest extent permitted by law, Growth Spurt will not be liable for any indirect, incidental, or consequential loss arising from your use of the service, and our total liability is limited to the amount you paid us (if any) in the 12 months before the claim.

9. Termination

You may stop using the service and delete your account at any time (see Data & account deletion). We may suspend or terminate access if you breach these Terms or to protect the service.

10. Changes

We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction, without affecting any mandatory consumer protections in your country of residence.
